The Supreme Court ruled 6-3 to overturn the 1984 decision in Chevron v. Natural Resources Defense Council. As Chief Justice John Roberts explained, Chevron “defies the command” of the Administrative Procedure Act.
Chevron is a 1984 Supreme Court case that produced the “Chevron deference,” a court-made rule giving massive power to administrative agencies. If the meaning of a statute is challenged and the language is “unambiguous,” that meaning is applied. But what if a court finds the words produce ambiguity in their meaning? The Chevron rule meant that it had to give extra weight to what an executive agency thought the real meaning was. That is now over. Roberts wrote:“The Administrative Procedure Act requires courts to exercise their independent judgment in deciding whether an agency has acted within its statutory authority, and courts may not defer to an agency interpretation of the law simply because a statute is ambiguous; Chevron is overruled.”
Chief Justice John Roberts wrote the Court’s decision after combining Loper Bright Enterprises v. Raimondo with Relentless, Inc. v. Department of Commerce for a joint decision. He was joined byJustices Clarence Thomas, Samuel Alito, Neil Gorsuch, Brett Kavanaugh, and Amy Barrett. Thomas and Gorsuch also filed concurring opinions. Justice Elena Kagan wrote in dissent, joined by Justices Sonia Sotomayor and Justice Ketanji Jackson, who recused herself from Loper.
