Restraining Order Trouble for Biden’s Vaccine Mandate

Temporary restraining orders – they aren’t just for stalkers.

by | Oct 23, 2021 | Articles, Law, Opinion

The court system directs Temporary Restraining Orders (TRO) for various destructive behaviors: stalking, destruction of property, sexual and physical assault, threats, and harassment – a veritable laundry list of creeper-type people and their obsessive crimes. But this week, add Joe Biden to the list. On Friday, Arizona Attorney General Mark Brnovich filed a request for a TRO to stop the Biden administration from implementing the controversial vaccine requirement on federal employees and businesses with 100 or more people on the payroll.

Arizona filed a lawsuit against the Biden administration in September. The suit claims a vaccine mandate for citizens while hundreds of thousands of illegal aliens are allowed to enter the country without proof of being tested or inoculated is a violation of the Equal Protection Clause by favoring illegal aliens over American citizens.

As Brnovich points out: “Once a vaccine has been administered, it can never be undone. The COVID-19 vaccine mandate is one of the greatest infringements upon individual liberty, federalism, and the separation of powers by any administration in our country’s history.”

Hence the 45-page TRO: Stop the mandate from going into effect in Arizona.

What Did Joe Do Now?

President Biden has painted himself into a corner again. Masks didn’t seem to work. Social distancing was violated routinely by those issuing the edicts. And now, with the vaccine available, half the country has decided to take a wait-and-see approach. The Johnson & Johnson version was pulled out of circulation for its link to developing blood clots. Other recipients have experienced anaphylaxis, myocarditis, and pericarditis, according to the Centers for Disease Control (CDC).

Immediately, most people taking the Fauci ouchie experience mild to moderate side effects lasting no more than a few days. But no one knows the long-term effects. That will only come with time and careful recording of data. Currently, the CDC shows after “[m]ore than 408 million doses of COVID-19 vaccines were administered in the United States from December 14, 2020, through October 18, 2021. During this time, Vaccine Adverse Event Reporting System (VAERS) received 8,878 reports of death (0.0022%) among people who received a COVID-19 vaccine.”

Arizona Will Not Comply

“The deadline for federal contractors to receive their first vaccine is approaching as early as Oct. 27, 2021, so time is of the essence. Unfortunately, the deadline for federal employees to receive their first Pfizer or Moderna vaccine has already passed.” The complaint further reads, “but the November 8 deadline for them to receive their second dose (or their first and only dose of the Johnson & Johnson vaccine) is just weeks away.”

New Banner Covid AffairsAnd Brnovich is digging in by further emphasizing what the mandate means for Arizona: an economic hit they can’t afford after pandemic lockdowns. Citing surveys showing “85% of businesses” said the difficulty in hanging on to willing workers would impact the bottom line and that 89% said some employees would quit, the request painted a bleak picture of Arizona’s future.

Arizona has stood up to perceived federal bullies before: Former president Barack Obama received a chilly reception from then-Governor Jan Brewer. Brewer shook a finger at him like a schoolmarm in a tense exchange, and Obama petulantly walked away mid-wag.

Joe Biden already isn’t as well-liked as Obama, and the man will not win friends and influence people to take the vaccine when he degrades his office by mocking those refusing his generous offer and deriding American freedom with snarky comments like this stuttered salvo: “I have the freedom to kill you with my COVID. No, I mean, come on, freedom.”

That attitude will not fly in the Grand Canyon. Just ask A.G. Brnovich, who says, “The COVID-19 vaccine mandate is one of the greatest infringements upon individual liberty, federalism, and the separation of powers by any administration in our country’s history.”

That tarmac in the heart of the desert is the coldest place in the state of Arizona.
