Making Free Speech Expensive – Antifa Gets Sued

by | Nov 27, 2017 | First Amendment

Antifa may finally get some just desserts; or at least some kind of retribution for their violent and aggressive attacks on those whose opinions differ with theirs.

The College Republican group from UC Berkeley in California is suing the group, in particular, Yvette Felarca, for $100,000 claiming damages on the basis that she and her group ‘By Any Means Necessary’ has “repeatedly threatened and harassed” former College Republican President Troy Worden and others on campus.

A press release by Mark Meuser, one of Worden’s lawyers, states that the lawsuit accuses Felarca of denying Worden’s constitutional rights. It reads, “Felarca filed a frivolous restraining order that restricted Worden’s First and Second Amendment rights and made it difficult for him to move around the campus to attend classes. The restraining order was dismissed on Oct. 27, 2017.”

BAMN

Felarca is a leader of BAMN, the “Coalition to Defend Affirmative Action, Integration, and Immigrant Rights and Fight for Equality By Any Means Necessary.” She is known for her vehement protests against President Donald Trump, and physical interference against Milo Yiannopoulos and others who try to exercise their freedom of speech. She is “twice-over out on bail for charges of assault, resisting arrest, and inciting a riot.”

Shanta Driver is Felarca’s attorney and also the national chair and founder of BAMN. Worden has asked to have Driver sanctioned by the court stating that as an attorney, she should have known better that the motion was frivolous and had been brought for the improper purpose of restricting Worden’s rights:

“Yvette Felarca and By Any Means Necessary have brought frivolous restraining orders against multiple persons in the last year – including myself – in an attempt to stifle free speech with which they disagree and would like to silence. All those restraining orders have been dismissed,” Worden said.

“Hypocritically, the Left has lamented for years that the justice system treats them and their causes unfairly, but here is a perfect example of their manipulating and abusing the justice system for their own ends. I am thankful for the hard work Mark Meuser and the Dhillon Law Firm have done to secure my First Amendment rights and defeat Felarca in court,” he continued.

Freedoms for the Rich

Trying to restrict free speech isn’t the only issue Worden and his attorneys are addressing. Meuser said: “Felarca and her attorney attempted to make free speech expensive, and it is time that they pay for their misuse.” They went further and challenged this as an abuse of power and privilege:

“This case represented a massive imbalance in power in that we had a poor college student about to lose his constitutional rights because a massive organization had the resources to try to crush him in court,” said Dhillon Law Group managing partner Harmeet K Dhillon. “The Dhillon Law Group is proud that we could help level the playing field and turn the tables.”

‘By any means necessary’ is indeed Felarca’s intent. It doesn’t matter if she violates others’ constitutional rights, promotes and engages in violence, and spreads half-truths, propaganda and outright lies to weak minded and easily influenced people; as long as she accomplishes her goals, nothing else matters.
