
One of the sticking points with President Joe Biden’s vaccine mandate, other than the brazen authoritarianism, has been questions over how his administration would enforce such a measure. The Occupational Safety and Health Administration (OSHA) was tasked with the implementation of the vaccine, but the agency seems to lack the resources to enforce this on a grand scale. Still, the White House seems to have figured out a way to make sure companies don’t flout the rules – despite the fact a federal court temporarily blocked the mandate.

The Biden administration intends to rely on “workplace whistleblowers” to ensure that companies remain in compliance with the president’s mandate since OSHA lacks the staffing levels to inspect these organizations, according to the Associated Press. The report explained that the government “will rely upon a corps of informers to identify violations of the order.”

However, the report also acknowledges that the tattletale tactic might not be as effective as the White House hopes. It is unknown how many employees would be willing to give up the goods on their bosses for not following King Biden’s royal vaccine decree to the letter. Would they be willing to put their own incomes at risk? Moreover, how many workers actually feel strongly enough about vaccine mandates to raise the whistle to their lips?
Debbie Berkowitz, a former OSHA chief of staff, told the AP: “There is no army of OSHA inspectors that is going to be knocking on employers’ door or even calling them.” She continued, explaining that the administration will “rely on workers and their union representatives to file complaints where the company is totally flouting the law.”
Jim Frederick, acting OSHA chief, told reporters that the agency will home in on job sites “where workers need assistance to have a safe and healthy workplace” and that this “typically comes through in the form of a complaint.”
OSHA is encouraging workers to first bring up potential violations to their employers “if possible” and the fact that they could file a confidential complaint with the agency. “You fill out a form, or somebody fills out a form for you,” said Berkowitz. “And that’s all workers have. If OSHA decides not to inspect, that’s it. Or if OSHA inspects but decides not to cite the employer, that’s it…so it’s a pretty weak law.”
Given that the success of Biden’s mandate depends on workers who would be willing to go through the process of ratting out their employers, one can see how difficult it may be to enforce. But it is also worth noting that this issue might not ever arise given that many companies are willingly following Biden’s guidance on requiring vaccines. Either way, if the courts end up ruling in the administration’s favor, the mandate will go into effect beginning January of next year.
