Coronavirus Lawsuit Fever Sweeps America

Litigation - whether for freedom, profit, or justice - is the new trend.

No good pandemic comes and goes without litigation. How else will the affected – not the inflicted – get by without a little extra jingle in the pocket? No matter the guy shelling out the jingle jangle, it’s a dog eat dog time, isn’t it? Folks hoarding toilet paper should have been the first clue to how Americans would react to being told what to do, when to do it, and how. Hard-working, freedom-loving patriots are simply “mad as Hell” and aren’t going to stand by, as this COVID-19 panic derails their country.

Temperatures are rising – or so it seems. The latest trend is swapping virus fever for sue fever. It’s time to indict for freedoms lost. Although some lawsuits involve business and not-for-profits nationwide, suing their insurers in Coronavirus-related legal disputes, it’s John Q. Public who is making noises of revolt.

Scott D. Cosenza, Liberty Nation’s legal affairs editor, notes:

“At least 30 COVID-19-related cases were filed around the nation Wednesday, bringing to at least 290 the number of such cases filed in the past nine working days; many of the new ones involve businesses claiming they are essential, and people protesting stay-at-home orders.”

If the government did not see this coming – after forcing children, parents, spouses, and roommates to endure one another for going on two months – they are too oblivious to be governing in the first place.

Overreach Much?

Of course, the latest trends involving the pandemic, now that the country is becoming wise to the idea that a lockdown may have been an overreaction to a nearly 99% survival rate, are coming to fruition. A lone man on a paddleboard in Huntington Beach, CA, was arrested once he returned to shore. He violated a stay at home order. Florida homeowners face jail time if they step one “foot in their own backyards,” if their property is beachfront. They are suing Walton County for allegedly preventing the enjoyment of their private beach.

Lawyers are going to be busy, and the cases are rolling in. For instance, one Pennsylvania small business owner and two former employees have filed a class action alleging the state’s order to close all non-essential employees runs afoul of federal protections. The suit claims that Governor Tom Wolf’s closure order violates the Fifth Amendment: Closing businesses without providing compensation.

In Vail, CO, one resort was hit with a lawsuit by a season pass holder who says he’s owed a refund after the indefinite closure of its ski resorts on March 25, 2020, claiming the resort is unjustly enriching itself. That may seem a tad petty over a $499 season ski pass, but I could have read that wrong. It’s the principle and all that.

But there are lawsuits pending that may have a popular following; some could be considered petty, and others might be regarded as Karma. A recent lawsuit claims that an eBay user has been selling N95 Coronavirus masks for $36 each when they typically retail for $2. Ohio’s Attorney General Dave Yost says user Donkey476 is essentially charging 1,700% more for the masks, and it looks as though this price gouger is going to get his butt kicked by the state’s top dog in law enforcement.

Some folks might find the next lawsuit amusing: Televangelist Jim Bakker claims he has a cure for COVID-19, and the great Show Me State of Missouri thinks not. They are suing Bakker for advertising on his show the Silver Solution, Silver Sol, and Optivida Siler Solution. For a donation of $85 to $125, viewers can get the cure that will “disrupt foreign elements without disturbing the body’s natural environment.”

Are we There Yet?

Social distancing guidelines and non-essential employees on furlough indefinitely, without pay, is wearing on Americans’ nerves. So much so, that the usual law-abiding citizen has taken to the streets to lash out at the oppressors. Protests are popping up nationwide – from Oklahoma and Texas to Idaho, Virginia, Michigan, Florida, California, Kentucky, Ohio, North Carolina, and Minnesota. Folks taking to their vehicles to descend on state capitols demanding their freedoms be reinstated. Now.

James Fite covered the protests for Liberty Nation, and put into words what Americans are thinking:

“No one wants to catch or spread COVID-19, but many are beginning to wonder if the so-called cure has turned out to be worse than the disease. Americans have been forced out of their jobs, and the bills are piling up. While the CARES Act provided paycheck protection and disaster loans to small businesses, that money is gone, and Congress can’t seem to agree on another bill.”

America must get back to work. Americans need to be free again. Is there is a lesson for folks to learn after surviving COVID-19? Yes. Remember how easy it was to take those birthright freedoms away. Bring on the hard lesson litigations.
